Terms of service

This Terms of Service agreement ("Agreement") constitutes a legally binding contract between Nerd Shirt Club, LLC (“Nerd Shirt Club,” “we,” “us,” or “our”), located at 10 S Paterson St #1211, Madison, WI 53703, and the individual or entity (“you” or “your”) who accesses or uses our website (www.nerdshirtclub.com) or subscribes to our monthly shirt club (collectively, the “Nerd Shirt Club Service”).
By accessing our website or subscribing to our service, you confirm that you are at least 18 years old and agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Nerd Shirt Club Service.
1. Membership and Use of Nerd Shirt Club
You may browse certain areas of the Nerd Shirt Club website without subscribing. However, full access—including receiving our monthly shirts—requires an active subscription. By subscribing, you agree to provide accurate and current information, including your name, email, phone number, shipping and billing addresses, and payment details. You represent that you have the legal right to use the payment method submitted.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you suspect unauthorized access or a breach, contact us immediately at service@nerdshirtclub.com.
You are responsible for ensuring your account details are up to date. This includes updating billing and delivery addresses, payment methods, and contacting your payment provider in case of a lost or stolen card.
2. Subscription and Billing Terms
By subscribing, you agree to receive and pay for a new t-shirt each month, selected by Nerd Shirt Club. Your subscription will automatically renew monthly, and your payment method will be charged unless you cancel before your next billing date.
Taxes: Sales tax may apply based on your shipping address.
Refund Policy: All sales are final. Payments are non-refundable once processed. If you cancel after billing but before fulfillment, we may, at our sole discretion, issue a refund if the shipment can be stopped.
Each shirt is shipped to the address on file. Risk of loss passes to you once the shirt is handed over to the shipping carrier. In the event of a lost package, we may (but are not obligated to) offer a replacement shirt or substitute item.
Exchanges: You may exchange your first shirt for a different size if unworn and unwashed.
Defective Items: We will make reasonable efforts to replace defective shirts. If unavailable, we may refund one month’s subscription fee as your sole remedy.
3. Nerd Vault & Nerd Hoodies Purchases – Retired T-Shirts & Hoodies Without Subscription
In addition to our monthly subscription service, customers may purchase retired t-shirts and hoodies from the Nerd Vault and Nerd Hoodies collections without an active subscription. These items are available for one-time purchase on our website while supplies last. Purchases are not subject to subscription billing and are final sale, with the same refund and exchange policies as regular products.
4. Membership Cancellation
You may cancel anytime via your account at www.nerdshirtclub.com. Cancellations take effect immediately unless we have already initiated your billing and fulfillment process. If cancellation occurs after processing begins, you will receive that month’s shirt, and cancellation will apply to the next cycle.
5. License to Use Website
Subject to this Agreement, Nerd Shirt Club grants you a limited, non-exclusive, non-transferable, revocable license to use our website for personal, non-commercial purposes.
You are responsible for complying with all applicable laws and regulations in your jurisdiction. We may terminate your access without notice if you breach this Agreement.
6. Changes to This Agreement
We may update this Agreement at any time. We will notify you via email (if you’re subscribed) or by posting the revised terms on our website. Your continued use of the Nerd Shirt Club Service constitutes your acceptance of the revised Agreement.
7. Intellectual Property
All content on the Nerd Shirt Club website—including logos, designs, and other intellectual property—is owned or licensed by Nerd Shirt Club, LLC and protected by law. “Nerd Shirt Club” is a trademark of Nerd Shirt Club, LLC.
You may not copy, reproduce, distribute, or exploit any content without our prior written consent. Any suggestions or feedback you provide may be used by us without compensation to you.
8. Privacy
Your use of our service is also governed by our Privacy Policy, which is incorporated by reference into this Agreement. If you have questions about your personal information, please visit our Privacy Policy page.
9. Disclaimer of Warranties and Limitation of Liability
THE NERD SHIRT CLUB SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NERD SHIRT CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO NERD SHIRT CLUB IN THE NINETY (90) DAYS PRECEDING YOUR CLAIM.
10. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of Wisconsin, without regard to conflict of laws. All disputes must first be resolved through good-faith informal negotiation. If unresolved after 30 days, disputes will be settled through binding arbitration conducted in Madison, Wisconsin, under the rules of the American Arbitration Association.
No Class Actions: You agree that disputes will be handled individually. Class action claims, representative actions, and consolidation with other claims are not permitted.
Exceptions: Intellectual property claims, theft, fraud, or misuse may be brought directly in court without arbitration.
11. Miscellaneous
Failure by Nerd Shirt Club to enforce any provision does not constitute a waiver. If any term is found unenforceable, the remainder of the Agreement remains in effect. This Agreement is the complete and exclusive statement of terms between you and Nerd Shirt Club and supersedes all prior agreements. You may not assign this Agreement. We may transfer or assign it without restriction. Section titles are for reference only.
12. Statute of Limitations
Any claim arising out of the Nerd Shirt Club Service must be filed within one (1) year of the date it arose, or it is permanently barred.
